PRIVACY POLICY December 1, 2003 The Privacy Policy of TAYLOR DEMERS MAIL PROCESSING INC. ("TDMP") is based on the understanding that a client's personal information is acquired only where necessary and is disclosed only for the purposes and to those parties whom its clients authorize release of such information in the course of providing mail processing and related services as defined in the client contract. 1. What is Personal Information? Personal information is information which allows third parties to identify you as an individual. In addition to compliance with all Privacy Laws affecting private businesses in the Province of Ontario, which requires consent on the part of the person providing personal information to allow the release of such information for specified purposes, we have a culture internal to our organization that personal information is disclosed to Employees or contractors only on a need to know basis and for specified purposes. 2. Limiting Collection. Our firm restricts the collection of personal information only to that information which is necessary for the limited purposes noted above and we are committed to collecting personal information in a fair, open and lawful manner. 3. Limiting Use, Disclosure and Retention Our firm does not use personal information for purposes other than those for which it was originally collected, unless it has first obtained the consent of the person from whom such information was received. We retain personal information only for as long as it is needed and only for the fulfillment of the purposes for which it was originally collected. 4. How to Add, Remove or Amend Your Personal Information. Our firm is committed to maintaining accurate, complete and up-to-date personal information. If you are aware of changes to the personal information you have given to us, simply inform us of the changes and we will update our records accordingly. You may check and correct your personal information by contacting our website at www.taylor-demers.com to add, remove or amend your personal information. 5. How Personal Information is Maintained. Our firm does not sell, barter, trade or give away your personal information to third parties. For example, we do not provide our client mailing list to other firms. Our firm stores and maintains personal information in conformity with the requirements of the Personal Information Protection and Electronic Documents Act (the "Act") and the Model Code for the Protection of Personal Information created and approved by the Canadian Standards Association (the "Code"). We meet the standards of the Code in the following ways: (a) Accountability: Our firm is responsible for the personal information collected and maintained by it and which is under its control. (b) We collect information only for the purpose of maintaining client contact lists and representing our clients to the best of our ability. No information is used for any purpose other than that for which it was originally collected. However, Privacy legislation does provide that in certain circumstances we can be required by law to disclose personal information to: (a) conform to obligations imposed by law or statute; (b) meet an emergency need; and/or (c) as required pursuant to a criminal investigation. We would in any such instance verify the validity of such request and act in compliance with the law and our professional duty to uphold solicitor client privilege. 6. Safeguards. Our firm has developed and implemented security safeguards appropriate to the sensitivity of the personal information kept by us, including the signing of a confidentiality agreement by each employee at the time of hire. If we use the services of any third parties to process personal information, we will enter into legal agreements, which require them to protect this personal information in a manner acceptable to us. Subject to the requirements of law, no information is ever disclosed except with your specific authorization to third parties. 7. Complaints. Disclosure of personal information to any third party requesting information on your behalf will require your signed written direction.
